Megastrength Security Services Company Limited (MSS) Privacy Policy Statement for the eleave App eLMS

 

Privacy Policy

Megastrength Security Services Company Limited (MSS) is concerned to ensure that all personal data and documents submitted into its eLeave App eLMS are handled in accordance with the relevant provision of the Personal Data (Privacy) Ordinance. (PDPO)

Collection of Personal Data

Megastrength Security Services Company limited will collect data on its employees when they use the eLeave App eLMS. Data such as leave applied, duration and documents attached to support leave applications especially sick leave granted by doctors from various medical facilities be it private or public recording the days given and or reason for granting sick leave applied.

Use of Personal Data

The information provided by MSS employees may be disclosed to third parties such as law practices and Government Departments especially during the course of processing employee compensation and personal injury claims and or issues regarding payment for work undertaken.

Security Measures

Personal data collected is securely stored in the MSS eLeave App eLMS system and only trained or authorized staff shall have access.

Retention of Personal Data

MSS will take all reasonable practical steps to ensure that personal data is not kept longer than is necessary for the fulfillment of the purposes for which it is to be used. Personal data will be retained no longer than six months after there is no longer any need for its acquired usage.

Data Subject Rights

The data subject has the following rights under the PDPO;

  1. Right to be informed
  2. Right to access
  3. Right to rectification
  4. Right to erasure i.e. data is not kept longer than necessary
  5. Right to object/opt out

Access to and Correction of Personal Data

Under and in accordance with the PDPO an eLeave App eLMS user has the right to;

  1. Check whether MSS hold personal data about him/her and to access such data;
  2. Require MSS to correct any personal data held by MSS relating to him/her which is inaccurate and
  3. Ascertain MSS policies and practices in relation to personal data and to be informed of the kinds of personal data MSS holds.

Such requests can be made in writing to the MSS Personal Data (Privacy) Officer at the following address;

MSS may charge a fee for processing a data access request which will not be excessive. Request made in respect of data held by MSS have to be answered within 40 days from when the request was made.

Amendment of this Policy

MSS may from time to time amend and update this policy as MSS consider appropriate. The revised policy will be effective upon being posted in the App. Please check the policy posted in the App on a regular basis.

Acceptance of Policy

The Chinese version of this policy is for reference only. The English version will prevail if there are any inconsistency between the English and Chinese versions.

宏力保安服務有限公司 (MSS) 確保所有提交至其電子假期管理系統 (eLMS) 的個人資料及文件均按照《個人資料（私隱）條例》的相關條文處理。 (PDPO)

 

個人資料的收集

宏力保安服務有限公司將在員工使用電子假期管理系統 (eLMS) 時收集員工的個人數據資料。有關數據如休假申請、休假時段及用作假期申請的附加證明文件，特別是由各私人或公共醫療機構醫生授予的病假證明當中記錄的指定病假天數和/或申請病假的理由。

 

個人資料的使用

宏力保安服務有限公司員工的個人資料可能會披露給第三方，例如法律部門和政府部門，特別是在處理員工賠償和人身傷害索賠和/或有關工作薪酬問題的期間。

 

保安措施

收集到的個人資料數據會安全地存儲在宏力保安服務有限公司電子假期管理系統中，只有經過培訓或授權的人員才能訪問。

個人資料的保存

宏力保安服務有限公司將採取一切合理的實際措施，確保個人資料數據的保存時間不會超過履行其使用目的所需的時間。個人資料數據將在不需要使用後保留不超過六個月。

 

當事人權利

資料當事人根據《私隱條例》享有以下權利；

  1. 知情權
  2. 訪問權
  3. 整改權
  4. 刪除權，即數據的保存時間不會超過必要的時間
  5. 反對/退出的權利

 

訪問及更正個人資料

根據《個人資料（私隱）條例》，電子假期管理系統用戶有權：

  1. 檢查宏力保安服務有限公司是否持有關於他/她的個人數據並訪問這些數據；
  2. 要求宏力保安服務有限公司更正持有的與他/她有關的任何不准確的個人資料數據，以及
  3. 確定宏力保安服務有限公司與個人數據相關的政策和做法，並了解 宏力保安服務有限公司持有的個人數據類型。

上述要求可通過以下地址以書面形式向宏力保安服務有限公司數據保護主任提出 :

宏力保安服務有限公司可能會就處理數據訪問的要求收取合理的費用，並必須在收到提出要求後的 40 天內就持有的數據給予答复。
